• <br />RESOLUTION 2009-164R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE RENEWAL OF A PROPOERTY USE <br />AGREEMENT BETWEEN THE CITY AND TEXAS STATE UNIVERSITY <br />FOR THE CITY'S USE OF A PARKING AREA DOWNTOWN AND THE <br />UNIVERSITY'S USE OF A PARKING AREA ALONG CHARLES AUSTIN <br />DRIVE; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS <br />AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. The City owns property along Charles Austin Drive that Texas State University <br />has been utilizing for parking purposes. <br />2. Texas State University (the "University") leases property from the Texas State <br />University Support Foundation located behind the Support Foundation's Fire Station Studio in <br />downtown San Marcos which the City has been utilizing for parking purposes. <br />3. On March 3, 2003 the City and the University entered into an agreement for the <br />use of these parking facilities (the "Agreement"). <br />4. Both parties wish to renew the Agreement for an additional three year term <br />effective September 1, 2009. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The renewal of the attached Agreement between the City and the <br />University is approved. <br />PART 2. The City Manager, Rick Menchaca, is authorized to execute this <br />Agreement on behalf of the City. <br />PART 3. This Resolution shall be in full force and effect immediately from and <br />after its passage. <br />
