AMENDMENT NO. 1 <br />AMENDED AND RESTATED CONTRACT FOR COLLECTION AND DISPOSAL OF <br />SOLID WASTE AND RECYLCABLE MATERIALS <br />The City of San Marcos, (the "City"), 630 E. Hopkins, San Marcos, Texas 78666 and <br />Texas Disposal Systems, Inc. (the "Contractor"), P.O. Box 17126, Austin, Texas 78760-7126 <br />agree to amend Article 1, Section 1.3.2.1 D of the Amended and Restated Contract for Collection <br />and Disposal of Solid Waste and Recyclable Materials effective July 1, 2008 (the "Contract") for <br />the Contractor's provision of solid waste and recyclable materials collection and disposal <br />services to read as follows: <br />1.3.2.1 Single Stream Residential Recycling <br />D. Contractor shall provide monthly reports by the 10th day of the month following the end <br />of the previous calendar month that reflect the total tonnage of residential solid waste and <br />the total tonnage of single stream recyclable materials collected by Contractor in the <br />contract area. These reports shall be in a format deemed sufficient by the San Marcos <br />City Manager. If the total tonnage of single stream recyclable materials collected in the <br />contract area exceeds 90 tons per month in any running twelve-month period, Contractor <br />shall provide to City a credit of $3,000 in the value of trees to be delivered from <br />Contractor's tree farm. After this has been achieved, when the recyclable materials <br />collected in the contract area exceeds 100 tons per month in any running subsequent <br />twelve month period, Contractor shall provide to City an additional credit of $4,000 in the <br />value of trees to be delivered from the Contractor's tree farm. After this has been <br />achieved, when the recyclable materials collected in the contract area exceeds 110 tons <br />per month in any running subsequent twelve month period, Contractor shall provide to <br />City an additional credit of $5,000 in the value of trees to be delivered from the <br />Contractor's tree farm. City shall specify tree types, quantities, and delivery locations. <br />Other incentives may be negotiated at the end of the initial contract term in consideration <br />of contract extensions. <br />All remaining terms and conditions of the Contract shall remain in full force and effect <br />for the duration of the Contract. <br />By the signing of this amendment, the parties understand and agree that this amendment <br />shall become a part of the Contract identified above. <br />This amendment is effective December 1, 2009. <br />Amendment #1 to TDS (Clean Version)Agreement 1
