collusion, or unlawful means, or which exceeds the arbitrator's jurisdiction or which is based on <br />legal conclusions or interpretations which are clearly contrary to existing law. <br />Section 5. Mutual Extension. <br />All deadlines within this article may be waived or extended by written mutual agreement by the <br />Parties. Failure to adhere to the time limit at Step I shall result in the matter being considered <br />satisfied and no further action shall be taken. If the last day of any time period herein falls on a <br />Saturday, Sunday or City holiday, the time period will be extended to the next business day. <br />ARTICLE 12 <br />RESPONSE TIME <br />The parties acknowledge that City policy in Section 7.60 of the City Employee Handbook <br />regarding a timely response applies to all Firefighters who have taken the entrance examination <br />and hired after January 1, 2010, as a condition of employment upon completion of probation. <br />The reasonable response time for all such Firefighters regardless of assignment is established to <br />be 40 minutes from their permanent residence to the corporate City limit as of the date of this <br />agreement. The parties agree that this Article supersedes any conflicting provisions of Section <br />150.021 and Chapter 143 of the Texas Local Government Code. <br />ARTICLE 13 <br />ASSOCIATION BUSINESS LEAVE <br />Section 1. Time Off For Association Business. <br />An Association business leave time pool (the Pool) shall be created for the purpose of <br />conducting Association business. Association business is defined as time spent in Meet and <br />Confer negotiations, adjusting grievances or in dispute resolution process, attending the annual <br />State Firefighters' conference, the Association's Executive Board meetings, and regular <br />Association business meetings. It is specifically understood and agreed that Association pool <br />time shall not be utilized for legislative and/or political activities. No Association pool time shall <br />be utilized for activities prohibited by Section 143.086 of Chapter 143 or by the Texas Ethics <br />Commission. Nothing contained in this Subsection is intended to limit the use of the individual <br />firefighter's remaining vacation time by the firefighter for legislative and/or political activities. <br />Section 2. Establishment of Association Leave Time Pool. <br />The Pool shall be funded by a reduction of annual vacation leave accumulation in the amount of <br />three (3) hours per Fire Fighter, during the first pay period of the calendar year. In the first pay <br />period of each calendar year of this agreement, the City shall fund the Association Leave Pool in <br />an amount equal to three (3) hours multiplied by the number of employees in the bargaining unit <br />on that date. Any bargaining unit member who does not wish to contribute their three (3) hours <br />in any calendar year must provide notice in writing to the City Human Resource Department at <br />15
