r <br />Owner understands and agrees that all personal property must be removed from the Property by <br />November 30, 2009. The City will consider any items remaining to have been abandoned. <br />City agrees to construct or reconstruct driveways to the road as shown on the attached "Exhibit <br />D". If culverts are necessary for the construction of the driveways, reinforced concrete pipe will <br />used. <br />City agrees to survey and stakeout the Property to be conveyed as soon as is reasonably possible. <br />City agrees, at its sole expense, to move the current water meter and utilities on south portion of <br />the Property in such a manner as to allow Owner continued access to the meter and utilities. <br />If this sale or City's use of the Property results in the assessment of additional taxes for periods <br />before closing, City will pay the additional taxes. <br />After the date of payment of the purchase price, you will be reimbursed for any fair and <br />reasonable incidental expenses necessarily incurred in transferring title to the property for use by <br />the City of San Marcos. Expenses eligible for reimbursement may include (1) recording fees, <br />transfer taxes and similar expenses incidental to conveying the real property to the City and (2) <br />penalty costs for prepayment of any preexisting recorded mortgage entered into in good faith <br />encumbering the real property. Voluntary unnecessary expenses or expenses incurred in clearing <br />questionable title will not be eligible for reimbursement. Eligible incidental expenses will be <br />reimbursed upon submission of a claim supported by receipted bills or other evidence of actual <br />expenses incurred. You may file a written request for review if you believe that the City failed to <br />properly determine the eligibility for or the amount of incidental expenses to be reimbursed. <br />There is no standard form on which to request a review of a claim; however, the claim must be <br />filed with this office within six months after you are notified of the City's determination on any <br />claim for reimbursement. <br />The payment of the amount herein stated and the terms provided constitute the only promises, <br />consideration and conditions of this purchase; and, no other promises, consideration or <br />conditions have been signified or implied, save and except any benefits which may accrue to you <br />under the state's Relocation Assistance Program and the mutual benefits to be derived by you and <br />the City of San Marcos from the signing of this agreement. <br />The City, without cost to you as the owner, will pay the cost of recording all instruments con- <br />veying title to the City. <br />Independence Title Company located at 113 N Guadalupe St, San Marcos, Texas has been <br />designated as the City's closing agent and is responsible to see that the City of San Marcos <br />obtains clear title.
