Section 2. Vacation. <br />Notwithstanding TLGC § 143.046, Officers will accrue vacation leave on the basis of hours, not <br />working days. Officers with less than ten (10) years of service will accrue up to of one hundred <br />twenty (120) hours of vacation leave per calendar year, and Officers with ten (10) years of <br />service or more shall accrue one hundred and sixty (160) hours per calendar year. Officers will <br />use and accumulate vacation leave as per City policy. This provision shall, to the extent of any <br />conflict, supersede, any state statute, including TLGC § 143.046, any City ordinance, Police <br />Department rule or local Civil Service rule. <br />Section 3. <br />At time of separation, an Officer shall be paid accumulated sick leave and vacation leave as per <br />City policy at the hourly rate of base pay at time of separation. This provision shall, to the extent <br />of any conflict, supersede any state statute, including TLGC § 143.045 and 143.046, any City <br />ordinance, City policy, Police Department rule or Local Civil Service rule. <br />ARTICLE 12 <br />PROMOTIONS <br />Section 1. Eligibility for Promotion. <br />A. Police Corporal <br />1. An Officer is not eligible for promotion to the classification of Police Corporal unless the <br />Officer has served in the Department in the next lower classification for at least four (4) <br />years immediately before the police corporal promotional examination date. <br />2. If there are not sufficient Police Officers with four (4) years or more service in the next <br />lower classification who have timely applied to take the examination to provide an <br />adequate number of persons to take the police corporal examination, the commission may <br />open the examination to persons in that position with three (3) or more years service. <br />3. If there are not sufficient Police Officers with three (3) or more years service in that <br />position to who have timely applied to take the examination to provide an adequate <br />number of person to take the police corporal examination, the commission may open the <br />examination to persons in that classification with two (2) or more years service. <br />B. Police Sergeant <br />The promotional examination for Police Sergeant is open to each Police Corporal who for at <br />least two (2) years immediately before the examination date has continuously held the position <br />for Police Corporal in the San Marcos Police Department. In addition, commencing September <br />1, 2010, Corporals shall attend a mandatory supervisory or management training program <br />approved by the Chief designed for that rank of no less than forty (40) hours to be eligible to take <br />the Sergeant promotional examination. Commencing September 1, 2011 Corporals must also <br />have an Associate's Degree or at least sixty (60) hours (with a passing grade) of college hour <br />9
