The City has consented to the creation of the <br /> districts, adopted ordinances evidencing such consent, and approved a Consent <br /> Agreement for each district(collectively, the"Consent Agreements"). <br /> E. Owners, Developer and the City have held discussions regarding the long-term <br /> development of the Property and desire to define, protect, and clarify the City's <br /> jurisdiction and regulatory authority with respect to the Property through this <br /> Agreement, which is intended to create a program for annexation of the Property by the <br /> City, establish certain restrictions and commitments imposed and made by the Parties in <br /> connection with the development of the Property, provide increased certainty to the <br /> Parties concerning the development approval process and development requirements of <br /> the City, and identify land uses and other aspects of the Project. <br /> F. Pursuant to Chapter 242 of the Texas Local Government Code, the City has <br /> concurrent jurisdiction with the County(as hereinafter defined) over subdivision platting <br /> and all related permits for the Property. As required by Chapter 242, the City and the <br /> County have entered into the Interlocal Agreement (as hereinafter defined) relating to <br /> subdivision regulation in the extraterritorial jurisdiction of the City. <br /> NOW, THEREFORE, for and in consideration of the mutual agreements, covenants, <br /> and conditions contained in this Agreement, and other good and valuable consideration, <br /> the Parties agree as follows: <br /> ARTICLE I. <br /> DEFINITIONS <br /> Section 1.01 Definitions. In addition to terms defined elsewhere in this Agreement, <br /> each of the following terms shall have the meanings set forth below: <br /> "Building Code" means the International Building Code 2015 Edition. <br /> "Certified Inspector" means Bureau Veritas, or any other independent certified state- <br /> licensed inspector as agreed to in writing by Owners or Developer and the City to inspect <br /> Vertical Improvements as to their conformity with the Building Code. <br /> "City Council" means the City Council of the City or its successor governing body. <br /> "City Development Regulations" means the City Code of Ordinances, as may be <br /> amended from time to time, other than the Subdivision Regulations and the Design <br /> Criteria,laws,regulations,manuals,administrative rules,and policies, as they may affect <br /> or regulate land development within the Property. <br /> "City Manager" means an official appointed as the administrative manager of the City. <br /> 2 <br />
