<br />7 <br /> <br /> <br /> <br />Regular Meeting September 24, 1990 Page 7 <br /> <br /> <br />A RESOLUTION OF THE SAN MARCOS CITY COUNCIL CONCURRING WITH THE <br />APPLICATION ACTIONS FOR PRIVATE, LOCAL, STATE AND FEDERAL <br />FUNDING BY THE CAPITAL AREA RURAL TRANSPORTATION SYSTEM AND ITS <br />AGENTS FOR THE FINAL DESIGN AND IMPLEMENTATION OF A REGULAR <br />ROUTE RUBBER-TIRED TROLLEY-BASED TRANSIT SYSTEM FOR OPERATION <br />IN THE CORPORATE LIMITS OF THE CITY OF SAN MARCOS; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Plummer moved for adoption of the Resolution and Mr. Moore <br />seconded the motion. Jerry Romero, Chair of the Public <br />Transportation Committee (Temporary), provided the Council with a <br />written report containing letters of support, the committee <br />membership and a tentative routing schedule for the proposed transit <br />system. He stated if the City is successful in acquiring a grant, <br />the City will need a match of $142,000.00 in April, 1991. The <br />Council voted unanimously for adoption of the Resolution. <br /> <br />Mayor Morris introduced the City Manager's Report. Mrs. Brown <br />advised the Council Rosanna Wisener, a dispatcher at the Police <br />Department, is the Employee of the Month. <br /> <br />Mayor Morris introduced the City Attorney's Report. (1) Mr. Taylor <br />advised the Council he is drafting proposed amendments to the Taxi <br />Ordinance regarding the insurance requirements. (2) Mr. Taylor was <br />requested to check on whether or not the City has established a fee <br />for septic tanks to dump into the city's sewer system. <br /> <br />Mayor Morris introduced the City Council's Report. (1) Ms. Kissler <br />advised she has been elected as the President of TML Region VII. <br />(2) Mayor Morris stated she had received an anonYmous letter <br />regarding a need to clean up San Marcos and particularly the N. LBJ <br />area. She stated she was taking this opportunity to remind citizens <br />to help keep our City clean and encouraged the news media to <br />recognize areas of San Marcos that have made strides to clean up and <br />possibly recognize areas that need to do so. <br /> <br />Mr. Moore introduced for consideration an Executive Session pursuant <br />to Article 6252-17, Sections 2(e) and (g), V.A.C.S., to discuss <br />pending litigation (B. J. Allen vs. City of San Marcos; City of San <br />Marcos vs. LCRA), contemplated litigation and matters where the duty <br />of the City Attorney to the City pursuant to the Code of <br />Professional Responsibility of the State Bar of Texas clearly <br />conflicts with Article 6252-17; and evaluation of public employees <br />(City Manager, Municipal Court Judge, City Secretary), respectively. <br />Mr. Plummer moved to adjourn into Executive Session at 12:15 a.m. <br />and Mr. Hernandez seconded the motion, which passed unanimously <br />(Mayor Morris not present to vote on this item but did attend <br />Executive Session). <br /> <br />Mr. Plummer moved to reconvene from Executive Session at 12:40 a.m. <br />and Mr. Moore seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS OF A SETTLEMENT AGREEMENT BETWEEN B. <br />J. AND ODESSA ALLEN AND THE CITY; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE AGREEMENT AND RELATED DOCUMENTS; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for adoption of the Resolution and Mr. Moore <br />seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 12:41 a.m. on motion made by Mr. Guerra and <br />seconded by Mr. Moore. <br /> <br />~r <br />J' <br />rri .'..' <br />
