57 Regular Meeting October 22, 1990 Page 2 Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 3, ANIMALS AND FOWL, OF THE SAN MARCOS CODE OF ORDINANCES, PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES, PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. Ms. Kissler moved for approval of the Ordinance on first reading and Mr. Guerra seconded the motion. Gail Fields with PAWS is in favor of the Council's approval of the Ordinance. She thinks the Ordinance will save the City money. She suggested a provision be added to give chained dogs 150 square feet of mobility. Mr. Taylor recommended judicial authorization to enter someone's property. Mr. Moore stated he would like the Council to consider Mrs. Fields' request. Mr. Moore asked if the definition on Page 2 of vicious animal could be by breed. Mr. Taylor said the City could make a judgment call or could be breed specific. The Council requested a recommendation be brought to the Council for consideration regarding ticketing if cruelty is apparent if a dog is chained and not taken care of properly. Becky Reichenu requested amendment to Section 3.46(b) on Page 10 to include a rehabilitation permit license, and Mr. Taylor stated the language could be changed to take out "to keep as pet". The Council voted unanimously for approval of the Ordinance on first reading. Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ESTABLISHING FEES IN COMPLIANCE WITH THE PROVISIONS OF THE SAN MARCOS CODE OF ORDINANCES, CHAPTER THREE, ANIMALS AND FOWL, AND DECLARING AN EFFECTIVE DATE. Mr. Guerra moved for approval of the Ordinance on first reading and Mr. Moore seconded the motion. The Council requested information be brought to the Council regarding permits for animal establishments. The Council voted unanimously for approval of the Ordinance on first reading. Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 29 OF THE SAN MARCOS CODE OF ORDINANCES BY THE DELETION OF A STOP SIGN ON HUTCHISON STREET AT BLANCO STREET - EAST/WEST AND THE ADDITION OF A STOP SIGN ON BLANCO STREET AT HUTCHISON STREET - NORTHBOUND; THE DELETION OF THE PROHIBITION OF PARKING ON THE WEST SIDE OF BLANCO STREET BETWEEN HUTCHISON STREET AND BURLESON STREET; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING O~DINANCES; PROVIDING A PENALTY AND ESTABLISHING AN EFFECTIVE DATE. Ms. Kissler moved for approval of the Ordinance on first reading and Mr. Guerra seconded the motion, which passed unanimously. Mayor Morris introduced for consideration reconsideration of a Zoning Ordinance. The Council did not wish to reconsider the Ordinance. The caption of the Ordinance reads as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING LOT 16 OF WILLIAM GOFORTH'S FIRST SUBURBAN ADDITION AS RECORDED IN VOLUME 88, PAGE 80 OF THE HAYS COUNTY DEED RECORDS, LOCATED AT 1513 POST ROAD, FROM "M" (SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO "R-l" (SINGLE-FAMILY DWELLING DISTRICT); AND DECLARING AN EFFECTIVE DATE.
