Mr. Moore stated he supports <br />Resolution 12, as it has an effect on our recent devaluation. Mayor <br />Morris expressed concern about the report of the TML Legislative <br />Policy Committee on utilities and Environment opposing any mandated <br />source of separation, use of reuseable or biodegradable containers, <br />mandated recycling, mandated separation of yard wastes and mandated <br />composting and is anxious to find out why they are opposing. Mayor <br />Morris questions Resolution 21 pertaining to <br />annexations/disannexations which would allow cities to change city <br />boundaries within five months prior to a city election. Mr. Moore <br />stated it would be a good idea to look at Resolution 36 which would <br />request the Legislature to repeal Section 4212 of the Penal Code <br />related to animals because it is ineffective. Mr. Guerra requested <br />support of Resolution 35, which is the adoption of the whole report, <br />which Mr. Guerra advised is a good report. Ms. Kissler asked how <br />the Council feels about Resolution 58, regulating the cable <br />industry. Mayor Morris stated she is not in favor of regulating but <br />is anxious to hear the discussion. Mr. Moore stated San Marcos <br />could benefit from the Legislature adopting maximum flow standards <br />for plumbing fixtures (Resolution 57). <br /> <br />Mayor Morris introduced the City Manager's Report. (1) Mr. Gilley <br />advised Fred Sanderson has been appointed Assistant Director of <br />Public Works. (2) Mr. Gilley advised Chief Martin and the Police <br />Department in the last 24 hours have been involved with the Hays <br />County Drug Task Force and others in investigating a large drug <br />trafficking operation and in the seizure of 363 kilos of cocaine. <br />He expressed how proud we are of the success of the operation. <br /> <br />Mayor Morris introduced the City Attorney's Report. Mr. Taylor had <br />no report. Mr. Guerra requested information for an adopt-a-highway <br />program and an adopt-a-street program. He stated Greek Clean-up is <br />scheduled for November 10. <br /> <br />Mayor Morris introduced the City Council's Report. (1) Mr. <br />Hernandez stated San Marcos will host the quarterly spring meeting <br />of the Texas Association of Mexican-American Chambers of Commerce <br />January 25-26, 1991. (2) Mayor Morris stated she and some of the <br />City Council had dinner with the LCRA Board. Mayor Morris also said <br />she had been a guest of the Oilers at the invitation of Bud Adams, <br />and no determination has been made yet where Summer Camp will be <br />next year. (3) Mr. Moore stated John F. Williams, the Edwards' <br />mediator, would be making one more attempt to see where common <br />ground lies and if mediation is possible. He stated all feel the <br />press of time with the January 15 deadline. <br /> <br />Mayor Morris introduced for consideration an Executive Session <br />pursuant to Article 6252-17, Sections 2(e), (f) and (g), V.A.C.S., <br />to discuss pending litigation (City of San Marcos vs. LCRA; Johnny <br />Brady vs. Wayne Sneed; Amber Nichols vs. City of San Marcos; vicki <br />Sybert vs. City of San Marcos; Thomas Leining vs. Saucedo's Wrecker <br />Service), contemplated litigation, matters where the duty of the <br />City Attorney to the City pursuant to the Code of Professional <br />Responsibility of the State Bar of Texas clearly conflicts with <br />Article 6252-17; purchase of real property, lease of real property; <br />evaluation of a public employee (City Manager), respectively. Mr. <br />Hernandez moved the Council adjourn at 8:43 p.m. and Mr. Moore <br />seconded the motion, which passed unanimously. <br /> <br />Ms. Kissler moved the Council reconvene at 11:45 p.m. and Mr. <br />Plummer seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY OF <br />SAN MARCOS AND ENTEX, A DIVISION OF ARKLA, INC., FOR THE <br />CONSTRUCTION, MAINTENANCE AND OPERATION OF A NATURAL GAS <br />DISTRIBUTION SYSTEM IN THE CITY OF SAN MARCOS, HAYS COUNTY, <br />TEXAS; PROVIDING CONDITIONS CONTROLLING THE USE BY ENTEX OF <br />PUBLIC PROPERTY; ESTABLISHING STANDARDS OF SERVICE; PROVIDING <br />
