James <br />Hance of the Greater Austin Transportation Company stated they want <br />to provide a limousine service of a 1S-passenger bus. He said they <br />have quality service, they will get people where they want to go, <br />and thinks that it is a necessity for San Marcos. Pat Nordyke, <br />owner of the local taxi company, stated she is unaware of the fact <br />they cannot handle the needs of San Marcos. She stated they have a <br />10-passenger van and two 9-passenger wagons, and thinks the money <br />should stay in San Marcos. No one else wished to speak, so Mayor <br />Morris closed the public hearing. Mr. Guerra moved for adoption of <br />the Resolution and Mr. Moore seconded the motion. Mr. Taylor <br />indicated both companies, the existing taxi company and the company <br />requesting the limousine certificate, could be considered common <br />carriers. Mr. Moore stated there were complaints of the taxi <br />company's vehicles not being clean and the need for availability of <br />cabs, especially for the international students. The Council <br />discussed the definition of limousine. Taxis are fare rides on <br />demand and fixed routes and airport limousines are for fixed routes <br />to certain destinations. Mayor Morris stated she feels strongly <br />about free enterprise, and also feels strongly about a fair playing <br />field, and that the existing taxi company has the ability to serve <br />fares and fixed routes. Mr. Taylor indicated our Ordinances could <br />be much clearer by clarifying distinction of airport limousines. <br />Mayor Morris stated she wants amendments made to the Limousine <br />Ordinance defining separately airport limousines with fixed routes <br />and luxury limousines. Mr. Guerra stated he wants customers to be <br />able to access the best service they can. Mr. Taylor will bring an <br />amended Ordinance to the Council in four to six weeks for <br />consideration. Mr. Plummer moved to table this Resolution and Ms. <br />Kissler seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />AYE: Moore, Hernandez, Morris, Kissler, Plummer. <br /> <br />NAY: Guerra. <br /> <br />ABSTAIN: None. <br /> <br />(Mr. Hart out of the Council Chambers during this vote). <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1990-1991 <br />FISCAL YEAR TO PROVIDE INCREASED FUNDING FOR CITY PARTICIPATION <br />IN THE TEXAS HISTORICAL COMMISSION CERTIFIED LOCAL GOVERNMENT <br />GRANT PROGRAM AND DECLARING AN EMERGENCY. <br /> <br />Ms. Kissler moved for adoption of the Ordinance on emergency and Mr. <br />Moore seconded the motion. The original grant was $3,700, with the <br />City's match being $3,900 (City contributed $1J800, Hays County <br />Historical Preservation Commission $1,300, the Downtown Association <br />$400 and the Tourist Development Council $400), and some additional <br />grant funds in the amount of $1,000 have become available with the <br />City's match of $1,000. Mr. Plummer stated this is a tourism <br />project. The Council voted unanimously for adoption of the <br />Ordinance on emergency. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS DEFINING CITY RECORDS, DECLARING CITY RECORDS TO BE <br />PUBLIC PROPERTY; DESIGNATING A RECORDS MANAGEMENT OFFICER; <br />PROVIDING FOR THE DEVELOPMENT OF A RECORDS MANAGEMENT PROGRAM; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING FOR PUBLICATION AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading and <br />Mr. Moore seconded the motion, which passed unanimously. <br />
