RESOLUTION 2008-59R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF SAN <br />MARCOS AND HAYS COUNTY REGARDING THE IMPROVEMENT OF <br />MCCARTY LANE AND THE FUTURE COMPLETION OF LOOP 110; <br />AUTHORIZING THE INTERIM CITY MANAGER TO EXECUTE THIS <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br />RF.f iTAT.C• <br />1. The City of San Marcos (the "City") and Hays County (the "County") have <br />negotiated an interlocal agreement establishing their respective responsibilities regarding the <br />improvement of McCarty Lane and the future completion of Loop 110. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The terms and conditions of an Interlocal Agreement (the "Agreement") <br />between the City and the County establishing their respective responsibilities for the <br />improvement of McCarty Lane and the future completion of Loop 110 is approved contingent <br />upon the approval of the Agreement by the Hays County Commissioners Court. <br />PART 2. This Agreement is entered into pursuant to the Interlocal Cooperation Act, <br />Chapter 791 of the Texas Government Code, as amended. <br />PART 3. The Interim City Manager, Collette Jamison, is authorized to execute the <br />Agreement on behalf of the City. <br />PART 4.
