point approximately five-thousand, two-hundred-and-thirty-six (5,236) feet to the <br />east; and b) a four-lane road section approximately fifty-eight (58) feet wide, <br />including curbs and gutters, extending approximately nine hundred and twelve <br />and five tenths (912.5) feet from the end of the five-lane section to a point <br />meeting the County Segment defined in subsection 3.3 of this Agreement. City <br />and County acknowledge that portions of the City Segment are currently located <br />outside the corporate limits of San Marcos, Texas. The City Segment is depicted <br />on a map attached to this Agreement as Exhibit "A". <br />3.3 "McCarty Lane -County Segment" or "County Segment" means: a four-lane road <br />segment approximately fifty-two (52) feet wide, including curbs and gutters, to be <br />constructed by County that will extend approximately two thousand, one-hundred- <br />and-eighty-five and two tenths (2,185.2) feet from Old Bastrop Highway (FM 266) <br />to the west to a point meeting the City Segment. City and County acknowledge that <br />the County Segment is located within Hays County Commissioners Court Precinct <br />No. 1. The County Segment is depicted on a map attached to this Agreement as <br />Exhibit "A". <br />3.4 "FM 110" means: a five-lane and divided four-lane Texas Department of <br />Transportation facility that extends from IH 35 to SH 123. <br />3.5 "Road" or "road segment" also includes any culverts or bridges included in the <br />approved design of the Project. <br />3.6 "Pass Through Toll Agreement" means an Agreement between County and the <br />Texas Department of Transportation (TxDOT) that was signed by the County <br />Judge on November 11, 2006, became effective on December 20, 2006 when it <br />
