4) Grantee agrees (at no expense to Grantor) to install manholes along the <br />gravity portion of the wastewater line with wastewater stubouts at each <br />manhole for the developmental use of Grantor or Grantor's heirs, <br />successors or assigns. The elevation and direction of the stubouts shaft be <br />established by Grantor within 90 days of Grantee's notification of its <br />intention to exercise its option and payment of the consideration. In the <br />event Grantor does not identify the elevations and directions within that <br />time period, Grantee shall use its best judgement in designing the stubouts <br />with the future development of Grantor's land as the design criteria; <br />5) Grantor agrees that the City of San Marcos will own and operate the <br />wastewater line improvements that are the subject of the Conveyance, and <br />the actual terms and conditions of service to Grantor's property will be <br />determined by the City of San Marcos; and <br />6) Subject to full compliance by Grantee to the terms of this agreement, <br />Grantor consents to the fixture annexation of the easement area described <br />in the attached Conveyance by the City of San Marcos.
