RESOLUTION NO. 2025-160R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AND AUTHORIZING THE FILING OF <br /> AN APPLICATION WITH THE TEXAS WATER DEVELOPMENT <br /> BOARD (TWDB) SEEKING FINANCIAL ASSISTANCE IN AN AMOUNT <br /> NOT TO EXCEED $22,000,000.00 TO PROVIDE FOR THE COSTS OF <br /> CONSTRUCTION AND FINANCIAL SERVICES RELATED TO THE <br /> HIGHWAY 80 UTILITY PROJECT; DESIGNATING AN AUTHORIZED <br /> REPRESENTATIVE OF THE CITY FOR PURPOSES OF FURNISHING <br /> INFORMATION AND EXECUTING REQUIRED DOCUMENTS IN <br /> CONNECTION WITH THE PREPARATION AND FILING OF THE <br /> APPLICATION; DESIGNATING FIRMS AND INDIVIDUALS <br /> AUTHORIZED AND DIRECTED TO AID AND ASSIST THE CITY IN THE <br /> PREPARATION AND SUBMISSION OF THE APPLICATION AND <br /> APPEAR ON BEHALF OF AND REPRESENT THE CITY BEFORE ANY <br /> HEARING HELD BY TWDB ON THE APPLICATION; AND DECLARING <br /> AN EFFECTIVE DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. An application is hereby approved and authorized to be filed with the Texas <br /> Water Development Board (TWDB) seeking financial assistance in an amount not to exceed <br /> $22,000,000.00 to provide for the costs of construction and financial services related to the <br /> Highway 80 Utility Project. <br /> PART 2. The Director of Engineering and CIP, Shaun Condor, is hereby designated <br /> the authorized representative of the City of San Marcos for purposes of furnishing such <br /> information and executing such documents as may be required in connection with the preparation <br /> and filing of such application for financial assistance and the rules of the Texas Water <br /> Development Board. <br /> PART 3. The following firms and individuals are hereby authorized and directed to <br /> aid and assist the City in the preparation and submission of such application and appear on behalf <br /> of and represent the City of San Marcos before any hearing held by the Texas Water Development <br /> Board on such application, to wit: <br /> Financial Advisor: Dan Wegmiller <br /> Specialized Public Finance <br /> Engineer: Mark Evans and Collin Brewer <br /> Freese and Nichols, Inc. <br /> Bond Counsel: J.
