ORDINANCE NO. 2009 - 77 <br />. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER <br />MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY <br />CODE TO CHANGE THE TIME LIMIT ON TWO PARKING SPACES <br />LOCATED ON THE EAST SIDE OF THE 300 BLOCK OF NORTH LBJ <br />STREET FROM ONE HOUR TO FIFTEEN MINUTES DURING <br />BUSINESS HOURS; INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. The Traffic Register, required by Section 82.067 of the City Code of Ordinances needs to <br />be amended to change the time limit on two parking spaces located on the east of the 300 block <br />of North LBJ Street from one hour to 15 minutes limited to the hours beginning at 8:00 a.m. and <br />ending at 5:00 p.m.. One of the two spaces shall be the northernmost parking space on the east <br />side of the 300 block of N. LBJ Street; and the other space shall be the southernmost space on <br />the east side of the 300 block of N. LBJ Street (see attached map). The Parking Advisory Board <br />recommended this change at its August 12, 2009 meeting. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Pursuant to Section 82.066 of the City of San Marcos Code of <br />• Ordinances, the Traffic Register is amended to change the time limit from one hour to 15 <br />minutes on two parking spaces located as follows: (1) the southernmost parking space of the east <br />side of the 300 block of North LBJ Street, and (2) the northernmost parking space of the east side <br />of the 300 block of North LBJ Street. The fifteen minute (15) time limitation shall only apply <br />from 8:00 a.m. until 5:00 p.m. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 4. This ordinance shall be in effect ten (10) days from and after its passage, <br />and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br />PASSED AND APPROVED on first reading on December 1, 2009. <br />is
