ORDINANCE 2009 - 78 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS IMPLEMENTING THE RECOMMENDATION OF THE <br />2009 SUNSET ADVISORY COMMISSION REPORT BY RETIRING THE <br />BEAUTIFICATION COMMISSION, DRAINAGE ADVISORY BOARD, <br />MINORITY TOURISM DEVELOPMENT BOARD, TRANSPORTATION <br />ADVISORY BOARD, AND YOUTH COMMISSION; REPEALING <br />SECTIONS 2.111 — 2.112, 2.191 — 2.193, 2362 — 2.363, 2.364 — 2.365, AND <br />2.370.10 — 2.370.11, OF ARTICLE 3, CHAPTER 2 OF THE SAN MARCOS <br />CITY CODE PERTAINING TO SUCH BOARDS AND COMMISSIONS; <br />AND PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The 2009 Sunset Advisory Commission Recommendation Report (the Report) presented <br />to the San Marcos City Council on November 17, 2009 included a recommendation to <br />retire the Beautification Commission, Drainage Advisory Board, Minority Tourism <br />Development Board, Transportation Advisory Board, and Youth Commission. <br />2. The City Council concurs with the recommendation of the Report and has determined <br />is that it should be implemented through the adoption of this ordinance <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Beautification Commission, Drainage Advisory Board, Minority Tourism <br />Development Board, Transportation Advisory Board, and Youth Commission are hereby <br />abolished. <br />SECTION 2. The following sections of Chapter, 2, Article 3, of the San Marcos City Code are <br />hereby repealed: Sections 2.111 — 2.112, 2.191 — 2.193, 2362 — 2.363, 2.364 — 2.365, and <br />2.370.10 — 2.370.11. The section numbers of these repealed sections shall be reserved for future <br />codification. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />
