95.

RESOLUTION NO. 2003- 148 R

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN MARCOS, TEXAS DENYING A SPECIFIC USE PERMIT
TO JOHNNIE L. GREENWOOD AND ANNIE M.
GREENWOOD FOR A MOBILE HOME AT 508 CENTRE
STREET; AND DECLARING AN EFFECTIVE DATE.

RECITALS:

1. Johnny L. Greenwood and Annie M. Greenwood own property at 508 Centre Street, and
they have maintained a mobile home there for their son Ralph Greenwood under specific use permits
granted by the Planning and Zoning Commission.

2. Ralph Greenwood recently submitted an application to extend the period of the SUP to
allow a replacement manufactured home to be placed at the location. The Planning and Zoning
Commission held a public hearing on the application at its June 24, 2003 meeting, and at that
meeting the Commission voted to deny the request.

3. Johnny L. Greenwood and Annie M. Greenwood filed an appeal of the SUP denial with
the City Clerk's office under City Code Section 114.027 on July 3,2003.

4. The City Council conducted a public hearing on the appeal of the SUP denial on
September 8, 2003, and the Council finds that the appeal does not have merit. However, the Council
wishes to extend the time period for removal of the existing mobile home from the property.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
TEXAS:

PART 1. The City Council denies the appeal of Johnny L. Greenwood and Annie M.
Greenwood and disapproves the granting of a specific use permit to Johnny L. Greenwood and Annie
M. Greenwood for the use of a mobile home at 408 Centre Street. The existing mobile home on the
property must be removed by September 8, 2004.

P ART 2. This resolution is effective immediately upon its passage and adoption.

ADOPTED on September 8, 2003.

~~

cl4TEST: ~~
~M v ~

J . is K.
