14 <br />IA .. 11 1911 N -_ <br />Bonds Alliance Regional Water Authority Contract Revenue Bonds (Regional <br />Water Supply Contract Project — City of San Marcos, Texas), Series 2025C. <br />Bond Resolution The Resolution by the Board of Directors of the Alliance Regional Water <br />Authority Authorizing the Issuance of Alliance Regional Water Authority <br />Contract Revenue Bonds (Regional Water Supply Contract Project — City <br />of San Marcos, Texas), Series 2025C; and Resolving Other Matters Incident <br />and Relating to the Issuance, Payment, Security, Sale and Delivery of Such <br />Bonds approved by the Board of Directors of the Authority on October 29, <br />2025. <br />City's System The City's existing combined waterworks and/or wastewater disposal <br />system of the City, together with all future extensions, improvements, <br />enlargements, and additions thereto, including, to the extent permitted by <br />law, storm sewer and drainage and/or reclaimed water systems which are <br />integrated with the waterworks or wastewater disposal system, and all <br />replacements thereof. Provided that, notwithstanding the foregoing, and to <br />the extent now or hereafter authorized or permitted by law, the term City <br />System shall not include any waterworks or wastewater facilities which are <br />declared by the Authority not to be a part of the City System, and which are <br />hereafter acquired or constructed by the Authority with the proceeds from <br />the issuance of "Special Facilities Bonds," which are hereby defined as <br />being special revenue obligations of the City which are not secured by or <br />payable from the net revenues of the City System, but which are secured by <br />and are payable solely from special contract revenues, or payments received <br />from the City or any other legal entity, or any combination thereof, in <br />connection with such facilities; and such revenues or payments shall not be <br />considered as or constitute gross revenues of the City System, unless and to <br />the extent otherwise provided in the ordinance or ordinances authorizing the <br />issuance of such Special Facilities Bonds. <br />Contract The Regional Water Supply Contract by and among the Hays Caldwell <br />Public Utility Agency, the Cities of Buda, Kyle and San Marcos, Texas and <br />Canyon Regional Water Authority dated January 9, 2008 as amended by <br />Amendment No. 1 dated as of October 31, 2009 and Amendment No. 2 <br />dated as of December 21, 2023. <br />Resolution Resolution Approving a Resolution by the Board of Directors of the <br />Alliance Regional Water Authority Authorizing the Issuance of Contract <br />Revenue Bonds in an Aggregate Principal Amount of $12,015,000 for the <br />City of San Marcos, Texas in Connection with the Regional Water Supply <br />Contract Project; and Approving Other Related Matters approved by the <br />City Council of the City on October 21, 2025. <br />A-1 <br />ARWA I San Marcos 2025C I General Certificate <br />
