<br />value of $1000.00 or less shall be waived for each local taxing unit, as defined in the state <br />Tax Code, that is authorized to impose and is imposing ad valorem taxes on property. <br />Construction permit fees for projects funded in whole with Community Development Block <br />Grant funds shall be waived. The city council may grant a waiver of construction permit fees <br />for projects funded in part with Community Development Block Grant funds on a case-by- <br />case basis. A waiver under this section does not include contractor fees, license fees, or fees <br />charged under other chapters of this Code. <br /> <br />SECTION 3. Section 86.309 ofthe City Code is amended as follows (underlining indicates <br />added text; overstrike indicates deleted text): <br /> <br />Sec. 86.309. Exceptions and Exemptions. <br /> <br />(a) To encourage affordable housing, the city shall refund a percentage ofthe impact fees <br />paid for construction of a new single-family dwelling that qualifies for the refund under <br />affordable housing guidelines approved by the city council. <br /> <br />(b) Impact fees shall not be collected from any local taxing unit, as defined in the state Tax <br />Code, that is authorized to impose and is imposing ad valorem taxes on property. <br /> <br />(c) No wastewater impact fee shall be charged for an irrigation meter. <br /> <br />(d) No impact fee shall be charged for a fire line meter that serves only a fire suppression <br />system. <br /> <br />(e) To encourage water-efficient development, the city shall refund a percentage of the <br />impact fèes paid for construction of a new single-family dwelling that qualifies for the refund <br />under water conservation guidelines approved by the city council. <br /> <br />(f) To encourage projects funded in whole by Community Development Block Grant funds. <br />no impact fee shall be charged for a project funded in whole by Community Development <br />Block Grant funds. The city council may grant a waiver of impact fees for projects funded <br />in part with Community Development Block Grant funds on a case-by-case basis. <br /> <br />(gL The city manager is authorized to adopt and administer guidelines for applying the <br />provisions of this section. <br /> <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 5. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed <br /> <br />SECTION 6.
