(5) the Housing Authority of the City of San Marcos for construction projects on • <br />propertv owned by it, for low-income housing or administrative offices• and <br />(6) any taxing unit as defined under Section 1.04 (11) of the Texas Tax Code for <br />construction projects having a permitted value of $1,000.00 or less. <br />SECTION 2. Chapter 74, Streets and Sidewalks, Article 2, Streets and Alleys, Division <br />3, Abandonment, Section 74.088, Application, of the San Marcos City Code is hereby amended <br />to read as follows: (underlinine indicates added text; o~~e indicates deleted text): <br />Sec. 74.088. Application. <br />(a) Street and alley abandonments will be initiated by the submission of an application <br />for abandonment on a form provided by the department. <br />(b) An application must be submitted either by a person owning property abutting the <br />segment to be abandoned or by the city staff. <br />(c) An application must be accompanied by the following, unless it is submitted by the <br />city staff: <br />(1) An administrative fee established by the city council; and <br />(2) Documents indicating the consent to the abandonment by the owners of all property • <br />abutting the segment to be abandoned. The documents may consist of petition forms <br />provided by the department or any other instruments executed by the owners. <br />(d) The following entities shall be exempt from the administrative fee imposed under <br />this section: <br />(1) non-profit organizations receiving funds from the city through the city's Community <br />Development Block Grant or Human Services pro rg ams• <br />(2) the city when using city employees on a constructionproject of the cites <br />(3) contractors hired by the city to work on construction projects of the cites <br />(4) San Marcos Reinvestment Corporation and San Marcos Habitat for Humanity when <br />building new affordable sin le family residential dwellings• <br />(5) the Housing Authority of the City of San Marcos for construction~rojects on <br />propertv owned by it, for low-income housing or administrative offices• and <br />(6) any taxing unit as defined under Section 1.04 (11) of the Texas Tax Code for <br />construction projects having a permitted value of $1 000.00 or less • <br />2 <br />
