• building construction, public infrastructure installation or improvement); <br />2. Determine the nature and extent of public facilities or infrastructure, if any, that <br />would be associated with or impacted by the development; <br />3. Confirm that the proposed development requires a decision, permit or approval by the <br />city under the city Land Development Code before the development is initiated; <br />4. Confirm the manner in which the proposed development contributes to completion of <br />the project for which the decision, permit or approval is sought, if the development is part <br />of a larger project; and <br />5. Confirm the specific type of decision, permit or approval that is required by the city <br />for the development under the city Land Development Code before the development is <br />initiated. <br />The responsible official shall presume that an application provides "fair notice of the <br />project and the nature of the decision, permit or approval sought" if the application is <br />submitted on the proper application form promulgated by the City in the Technical <br />Manual, is accompanied by all required attachments, and reasonably appears to be <br />complete. <br />(2) Project means a development that requires a decision, permit or approval by the city <br />under the City Land Development Code before it is initiated. <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 6. This Ordinance will take effect upon publication of its caption in a <br />newspaper of general circulation in the City but not less than 10 days after its final adoption. <br />PASSED AND APPROVED on first reading on April 1, 2008. <br />PASSED AND APPROVED on second reading on April 15, 2008. <br />PASSED, APPROVED AND ADOPTED on May 6, 2008. <br />Susan Narvaiz <br />Mayor <br />9 <br />
