RESOLUTION NO.2026-05R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING A REQUEST FOR <br />REIMBURSEMENT FROM THE TEXAS DEPARTMENT OF <br />TRANSPORTATION FOR UP TO $2,524,112.00 FOR AN ABOVE <br />GROUND FUEL STORAGE SYSTEM PROJECT FOR THE SAN MARCOS <br />REGIONAL AIRPORT IN THE ESTIMATED AMOUNT OF $3,000,000.00; <br />AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO <br />EXECUTE ALL CONTRACTS AND AGREEMENTS NECESSARY TO <br />OBTAIN SUCH REIMBURSEMENT AND TO EXECUTE A <br />DESIGNATION OF SPONSOR'S AUTHORIZED REPRESENTATIVE ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, the City of San Marcos intends to make certain improvements to the San <br />Marcos Regional Airport; and <br />WHEREAS, the general descriptions of the projects are described as: Above Ground Fuel <br />Storage Facility Fuel Project; and <br />WHEREAS, the City of San Marcos intends to request financial assistance from the Texas <br />Department of Transportation for these improvements; and <br />WHEREAS, the total cost of the Above Ground Fuel Storage Facility Fuel Project is <br />estimated not to exceed $3,000,000.00; and <br />WHEREAS, the City of San Marcos' share of the cost is estimated not to exceed <br />$475,888.00; and <br />WHEREAS, the federal share of the costs are not to exceed $2,524,112.00 which is the <br />amount for which the City Council of the City of San Marcos now desires to seek reimbursement <br />for the Above Ground Fuel Storage Facility Fuel Project; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS: <br />PART 1. A request for reimbursement from the Texas Department of Transportation <br />(TXDOT) for the Above Ground Fuel Storage Facility Fuel Project for the San Marcos Regional <br />Airport in the estimated amount of $2,524,112.00 is hereby authorized. <br />PART 2. The City of San Marcos authorizes the City Manager, or her designee, to <br />execute all contracts and agreements with TXDOT as necessary to seek the reimbursement from <br />TXDOT and to execute the attached Designation of Sponsor's Authorized Representative <br />designating Shaun Condor, P.E. — Director of Engineering as the City of San Marcos authorized <br />representative for the project who has the authority to make approvals and disapprovals as <br />required for the project on behalf of the City of San Marcos. <br />
