117. STATE USE CONTRACT THIS CONTRACT is entered into by and between the Receiving Party and the Performing Party (Easter Seals Central Texas) pursuant to the authority granted in compliance with the provisions of Chapter 122, Human Resources Code, and certified by Texas Industries for the Blind and Handicapped (TIBH) as a contract in compliance with the provisions of Chapter 122, Human Resources Code. AGREEMENT In consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed as hereinafter set forth, it is agreed as follows: Article 1. CONTRACTING PARTIES Receiving Party: City of San Marcos, Texas Performing Party: Easter Seals Central Texas Article 2. CONTRACT PERIOD The contract period for this agreement shall begin on October 1 , 2003, and shall end on September 30,2004. Article 3. SERVICES TO BE PERFORMED The statement of services to be performed under this contract is as follows: Removal of vegetation and debris from downtown areas of San Marcos on a 12 cycle per year basis, with each cycle to correspond to one cut for every 30 day interval. Removal of vegetation and debris from rig ht-of-ways , vacant land, alleyways and a pond on a four cycle per year basis (February, April, June, August). Cutting of vegetation in creek/channel/drainage areas on a three cycle per year basis (December, April and July). Mowing of ball field up to 64 cuts per year. Flowerbed maintenance (various City facility locations) as requested. In those areas that require the use of a mower, the height of the blades will be set at a maximum of 2-3 inches. For those areas requiring the use of weed-eaters the performing party will strive to maintain a uniform height. These services are to be performed in 1
