<br />13. Purpose. This release shall be liberally construed to promote its underlying purpose <br />which is to insure an end to all pending litigation and to preclude all future litigation concerning the <br />matters herein released. <br /> <br />14. Denial of Wrongdoing. Each Party denies any and all allegations of wrongdoing or <br />actionable conduct asserted by another Party, and each Party acknowledges this agreement is not an <br />admission of liability by any Party or of any of their masters, agents, servants, representatives, <br />employees, risk pools, attorneys, parents, subsidiaries, predecessors, or successors in interest, as <br />they all specifically deny liability, nor is it a comment on the nature or extent of any alleged <br />damages. This agreement is simply, besides being a release, a compromise and settlement of all <br />claims disputed. <br /> <br />15. Payment Own Fees, Costs, and Expenses. Each party will pay its own fees, costs, and <br />expenses including but not limited to those incurred because of the Litigation and the negotiation, <br />preparation and execution of this Agreement and the entry of the Final Judgment. <br /> <br />16. Parties Bound. The parties, and each of them, have agreed, by and through their <br />respective authorized representatives, that the tenns and conditions of this Agreement shall be <br />binding on the parties and their respective, heirs, successors and assigns, and any person or entity <br />claiming through them, now and in the future. <br /> <br />IN WITNESS WHEREOF, the authorized representative of each party has signed this <br />Agreement as of the date(s) indicated below. <br /> <br />[Signature Pages and Exhibits Follow] <br /> <br />- 11 - <br />
