ORDINANCE NO. 2003- 56 (') :Þ. ;::0: c.... ~ '< (')C i?z--.". 2.~ :z ~ cn-<...... ~ï ~ ~ ...... 5m ~~ r'-' ~O ~ ^ g ¡¡;.; g (.ù 3: 0' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, A1"\JNEXING TO THE CITY A TRACT OF LAND CONTAINING 26.26 ACRES, MORE OR LESS, LOCATED OFF OF AND SOUTHEAST OF THE 2200 BLOCK OF IH-35 NORTH (HOLT TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING FOR PUBLICATION AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on July 7, 2003 , and on Jul v 14, 2003 , to consider the proposed annexation by the City of 26.26 acres, more or less, located off of and southeast of the 2200 block of IH-35 North, in Hays County, Texas (Holt Tract), consisting of the tract of land described by metes and bounds in the attached Exhibit A (the "Annexation Area"). 2. The City has received a petition for annexation from the owner(s) of the property included in the Annexation Area, a copy of which is attached as Exhibit C. 3. An on-site public hearing has not been requested in writing by more than 10% of the adults who are permanent residents of the Annexation Area. 4. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on June 25, 2003 and July 2. 2003 , these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet website on or after the'20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the website until the dates of the respective hearings. 5. Prior to the publication of the notices of the public hearings, the City Council directed preparation of a service plan that provided for the extension of municipal services to the Annexation Area. 6. The proposed service plan was made available for inspection and explained to the residents, if any, of the Annexation Area at the public hearings. 7. The Annexation Area is contiguous and adjacent to the current boundaries of the City. 8. Notice of all meetings of, and all deliberations of, the City Council involving the annexation of the Annexation Area, including public hearings and the vote( s) on adoption of this ordinance, were done and performed in accordance with the Texas Open Meetings Law, TEX. GOy'TCODEANN. Chapter 551, as amended.
