<br />26. <br /> <br />RESOLUTION NO. 2003- <br /> <br />74 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING AN EARNEST MONEY <br />CONTRACT WITH VERNON LEJ\.1ENS FOR THE ACQUISITION <br />OF A RIGHT-OF-WAY EASEMENT FOR THE DAVIS LANE <br />PROJECT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City Council has awarded a construction contract for the Davis Lane Project. <br /> <br />2. The Davis Lane Project necessitates the acquisition of a right-of-way easement by the City <br />from Mr. Vernon Lemens. <br /> <br />3. The City staff has negotiated an earnest money contract for the acquisition of the needed <br />right-of-way easement from Mr. Vernon Lemens, and the City Council wishes to approve the <br />contract. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached earnest money contract with Vemon Lemens for the acquisition of <br />a right-of-way easement from Vernon Lemens for the Davis Lane Project is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the earnest money <br />contract on behalf of the City of San Marcos. <br /> <br />PART 3.
