• ADDITIONAL INTERLOCAL PARTICIPANT AGREEMENT <br />City of San Marcos, Texas <br />This Additional Interlocal Participant Agreement ("Additional Participant Agreement") <br />is entered into by the Lower Colorado River Authority (hereinafter "Provider"), acting for itself <br />and the Participants in that certain Interlocal Agreement for telecommunication services dated <br />the 15th day of January, 1997 (the "Interlocal Agreement") and the City of San Marcos, Texas, <br />(hereinafter designated "Additional Participant"), for the purposes of engaging Provider to <br />provide land mobile radio services for the support of governmental functions and services within <br />Additional Participant's service area. <br />WHEREAS, Provider has in place or is implementing a regional trunked 900 MHz <br />radio system (the "Trunked Radio System") to serve Provider's needs for communication and <br />public safety requirements; <br />WHEREAS, the Trunked Radio System has the capacity to serve the needs of <br />Provider and others requiring a Trunked Radio System for public safety, local government <br />• purposes and other purposes in compliance with applicable Federal Communications <br />Commission ("FCC") statutes, rules and licenses; <br />WHEREAS, the Trunked Radio System will, among other things, provide <br />dispatchable public safety mobile radio services pursuant to statutes and applicable FCC rules <br />enabling Provider to provide community assistance and economic development; and <br />WHEREAS, it would be of benefit to Provider to have other entities share the cost of <br />its system which it is developing and installing for its use; <br />WHEREAS, it would be a benefit to Additional Participant to receive Trunked Radio <br />System service on anon-profit, cost shared basis without investing the substantial capital cost <br />required for a completely separate infrastructure and by sharing the cost of the existing and <br />planned Trunked Radio System; <br />WHEREAS, Provider has secured Federal Communications Commission ("FCC") <br />radio licenses and a waiver of Section 90.179 of the FCC's rules, 47 C.F.R. *90.179, in order to <br />serve customers throughout its 58-county electric and water service territory; and <br />WHEREAS, the Trunked Radio System has the capability to provide interconnectivity <br />and a key communications link between public safety entities throughout the central Texas <br />• region. <br />
