RESOLUTION 2008-82R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE PURCHASE OF A PARCEL OF <br />LAND FOR RIGHT-OF-WAY TOTALING 18.4 ACRES, MORE OR LESS, <br />AND OBTAINING AN EASEMENT OVER 0.42 ACRES OF LAND, MORE <br />OR LESS, IN CONNECTION WITH THE WONDER WORLD DRIVE <br />EXTENSION PROJECT; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE ALL NECESSARY DOCUMENTS IN CONNECTION WITH THE <br />PURCHASE; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City of San Marcos, in partnership with the Texas Department of Transportation, <br />is in the process of extending Wonder World Drive from Hunter Road to RR 12 (the <br />"Project"). This Project is undertaken to provide an alternate route around the City <br />thereby relieving City streets and residents from some of the commercial traffic that is <br />currently passing through the City. <br />2. As part of the Project the City has reached an agreement with Craddock Partners, <br />LLC to purchase 18.4 acres of land for ROW and to obtain an easement over 0.42 <br />acres of land, for use associated with the Wonder World Drive Extension Project. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The following purchase of right-of-way in connection with the Wonder <br />World Drive Extension Project is hereby approved: <br />A. Parcel Number 6, in fee simple, consisting of 18.42 acres, more or less, as <br />depicted on the attached property description for Parcel 6; <br />less; <br />B. Parcel Number 6E, consisting of an easement over 0.42 acres, more or <br />The parcels purchased from Craddock Partners, LLC, for the total price of $ 370,660.00, <br />plus closing costs not to exceed 10% of the purchase price. <br />Part 2. The City Manager, Rick Menchaca, is authorized to execute all <br />necessary documents in connection with the right-of-way purchase described above on <br />behalf of the City. <br />Part 3. This Resolution is in full force and effect from and after its passage. <br />
