<br />2 Engineer will provide a copy of the plans and specifications to all Phase 2 Parties for their <br />information. The Phase 2 Engineer will assist the Phase 2 Project Manager in obtaining all <br />necessary permits for the Phase 2 Project from authorities having jurisdiction over the Phase 2 <br />Project (including but not limited to the City and railroad companies). <br />C. The Phase 2 Engineer will prepare construction contract documents, and provide to the City a <br />complete set of the documents, executed by the Phase 2 Project Manager and the construction <br />contractor (the "Phase 2 Contractor"). <br />D. The Phase 2 Engineer will perform periodic inspections of the work in progress at least monthly <br />throughout the construction period, will coordinate the inspections with the City's Department <br />of Environment and Engineering, and will provide written progress reports to all of the Phase <br />2 Parties based on the inspections. <br />E. The Phase 2 Engineer will review and render timely decisions on all contractor submittals, <br />including shop drawings, samples and as-built drawings. <br />F. The Phase 2 Engineer will review, consult with the City and the Phase 2 Project Manager, and <br />render decisions on all requests by the Phase 2 Contractor for significant changes to the plans, <br />specifications or other construction documents. The Phase 2 Project Manager willnotiry the <br />remaining Phase 2 Parties of any such revision and deliver to them a copy of any revised plans <br />and specifications. <br />G. The Phase 2 Engineer will detemline the amounts owing to the Phase 2 Contractor based on the <br />Phase 2 Engineer's on-site inspections and on evaluations of the Phase 2 Contractor's <br />applications for payment. <br />H. The Phase 2 Engineer will make recommendations to the Phase 2 Project Manager and the City <br />on the rejection of work which does not conform to the construction contract documents. <br />I. The Phase 2 Engineer will prepare minor changes in the plans and specifications as directed by <br />the Phase 2 Project Manager, and notify the City of all such changes; and will prepare necessary <br />change orders for approval by the Phase 2 Project Manager and the City. <br />J. The Phase 2 Engineer will conduct inspections to determine the dates of substantial completion <br />and final completion for the Phase 2 Project, issue final certificates for payment or take other <br />appropriate action, and make a written recommendation to the Phase 2 Project Manager and the <br />City regarding the acceptance of the Phase 2 Project. <br />K. The Phase 2 Engineer will provide periodic reports to the Phase 2 Parties at least monthly on <br />the progress of the Phase 2 Project and any revisions to the Phase 2 Project that have become <br />necessary. <br />L. The Phase 2 Engineer, through the Phase 2 Project Manager, will obtain the approval of all of <br />the Phase 2 Parties for all change orders which cause the original Phase 2 Project budget for <br />construction costs to increase by more than 5%, and for the cost, if any, for easement <br />acquisitions needed for the Phase 2 Project. <br /> <br />2.4. Construction of Phase 2 Project. The Phase 2 Parties agree that the Phase 2 Project Manager <br />will: <br />A. Obtain all necessary licenses and permits for the Phase 2 Project from authorities having <br />jurisdiction over the Phase 2 Project (including but not limited to the City and railroad <br />companies), and pay all fees related to such permits; <br />B. Procure and maintain commercial general liability insurance coverage insuring all of the Phase <br />2 Parties with respect to all construction operations under the contract; <br />C. Solicit bids from qualified contractors; <br /> <br />7 <br />
