<br />168. <br /> <br />AMENDMENT NO.1 TO <br />CONTRACT FOR TOURISM PROMOTIONAL SERVICES <br /> <br />This is Amendment No.1 to the Contract dated September 24, 2002 (the "Contract") <br />between the City of San Marcos, a Texas municipal corporation (the "City") and the San Marcos <br />Hispanic Chamber of Commerce (the "Chamber"). <br /> <br />1. The City and the Chamber agree to amend Section 4.B of the Contract as follows <br />(underlining indicates added text; overstrike indicates deleted text): <br /> <br />B. Any funds allocated to the Chamber by the City which are unencumbered or <br />unexpended on the effective date of the termination of this Contract shall be remitted to the City <br />on or before the expiration of thirty 30 days from the date of the termination-:-; provided, that if <br />the parties execute a new contract to renew the Chamber's tourism promotion services and <br />activities, the Chamber may use the funds for its usual and customary expenses until the date of <br />its first allocation of funds under the new contract, when it will remit the remaining funds under <br />this Contract to the City. <br /> <br />2.
