RESOLUTION NO.2025-212R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING AN AGREEMENT TO MUTUALLY <br />TERMINATE AN AMENDED AND RESTATED COTTON CENTER <br />DEVELOPMENT AGREEMENT AND CONSENT AGREEMENT <br />CONCERNING APPROXIMATELY 1,786 ACRES OF LAND IN <br />CALDWELL COUNTY, EAST OF THE CITY; AUTHORIZING THE CITY <br />MANAGER, OR HER DESIGNEE, TO EXECUTE SAID AGREEMENT ON <br />BEHALF OF THE CITY; APPROVING THE RELEASE OF SAID LAND <br />FROM THE CITY'S EXTRATERRITORIAL JURISDICTION; AND <br />DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. An agreement to mutually terminate an amended and restated Cotton Center <br />Development Agreement and Consent Agreement pertaining to creation of a municipal utility <br />district on approximately 1,786 acres of land in Caldwell County, east of the City, is approved. <br />PART 2. The City Manager, or her designee, is authorized to execute said agreement on <br />behalf of the City and to approve the final form of agreement consistent with this resolution. <br />PART 3. The release of said land from the City's extraterritorial jurisdiction is approved. <br />PART 4.
