<br />186. <br />Special Meeting <br /> <br />October 6, 2003 <br /> <br />Page 2 <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on second reading and Mr. <br />Thomaides seconded the motion. Mr. Taylor stated he feels these subareas <br />would need a great deal of expenditures. He also stated he feels the City <br />cannot afford to provide services to this area at this time. He stated he <br />feels the City and Council Members need to begin the healing process and <br />concentrate on the economic growth and development for the future of the <br />City. Mr. Thomaides stated he wants the community to know what exactly <br />will be affected in City services for this area due to the disannexation. <br />Mr. Thomaides inquired who would receive the tax bill if someone were to <br />move into this area on the first day of June. Rodney Gonzales, Director of <br />Finance, stated he would have to contact the Hays County Appraisal District <br />for that information. Mayor Habingreither inquired whether tax bills get <br />pro-rated with a portion going to the original owner and the other portion <br />going to the new owner. Mr. Gonzales stated he would have to get the <br />answer from the Hays County Tax Assessor. Mr. O'Leary stated the only <br />municipal tax liability for the disannexed area is 23 days, if the <br />disannexation goes into effect by October 23, 2003. Mr. Thomaides asked <br />which year is covered by the tax bill that was sent out in October and is <br />due January, 2004. Mr. Gonzales stated citizens receive a tax bill in <br />October for the current fiscal year, which has to be paid by January. Ms. <br />Narvaiz stated she feels only four Council Members can vote on this issue <br />without a perceived conflict of interest. She stated previous staff <br />provided information and the previous Council made their decisions based on <br />that information. Mr. Mihalkanin stated the annexation was definitely <br />legal. Mayor Habingreither stated he feels everyone on the Council is <br />trying to do what he or she feels is right. Mr. O'Leary stated he would <br />like to inform the residents in the Southwest San Marcos area that Staff <br />has had a discussion with the South Hays County Fire District, and if this <br />area is disannexed, there may not be an entity that will be responsible for <br />fire protection. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Thomaides, Mihalkanin, Habingreither, Montoya and <br />Taylor. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Diaz. <br /> <br />Mayor Habingreither introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CITY CODE SECTION 2.351 TO REVISE THE COMPOSITION OF THE <br />CONVENTION AND VISITORS BUREAU BOARD; INCLUDING PROCEDURAL PROVISIONS; <br />AND DECLARING AN EMERGENCY. <br /> <br />Ms. Narvaiz moved for adoption of the Ordinance on emergency and Mr. <br />Thomaides seconded the motion. Mr. Mihalkanin stated he had received an <br />email from Joe Castillo regarding an additional ex-officio member. He <br />stated he would like for this to be a discussion item at the next Regular <br />Council Meeting. Mayor Habingreither stated the revision is regarding the <br />City Parks and Recreation Department Director changing to City Parks and <br />Recreation Staff. Ms. Narvaiz inquired whether this change was discussed <br />with the Convention and Visitors Bureau Board. Mr. Mark Taylor stated this <br />change was a direction from the Council.
