• ORDINANCE 2009-83 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS TEXAS APPROVING THE RENAMING OF SAN MARCOS <br />FIRE AND RESCUE BACK TO ITS HISTORICAL NAME - SAN <br />MARCOS FIRE DEPARTMENT; AMENDING SECTION 62.188 OF <br />THE SAN MARCOS CITY CODE TO REFLECT THE CHANGE; AND <br />INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. In February 2004, by Ordinance 2004-8, the San Marcos Fire Department was <br />renamed San Marcos Fire and Rescue. In recognition of the Fire Department's upcoming 125th <br />Anniversary, the Fire Department supports changing the name back to its historical name - San <br />Marcos Fire Department. Additionally, the change would also assist in standardizing the <br />department's name so that emblems, badges and document all carry the same designation (which <br />is not currently the case). <br />2. An amendment to City Code is needed to implement this change. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS <br />TEXAS: <br />• SECTION 1. San Marcos Fire and Rescue is renamed San Marcos Fire Department. <br />SECTION 2. Section 62.188 of the San Marcos City Code is amended as follows (strikethrough <br />denotes deleted text, and underline denotes added text): <br />Section 62.188 Name of department. <br />The official name of the fire department is San Marcos Fire Department ^"'amxv Rescue. All <br />references in the City Code to "fire department" or "San Marcos Fire and Rescue <br />Dot" mean San Marcos Fire Department an . <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with <br />this ordinance are repealed <br />SECTION 5. This Ordinance will take effect upon final passage. <br />PASSED AND APPROVED on first reading on December 16, 2009. <br />0
