• ORDINANCE 2009-83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS TEXAS APPROVING THE RENAMING OF SAN MARCOS FIRE AND RESCUE BACK TO ITS HISTORICAL NAME - SAN MARCOS FIRE DEPARTMENT; AMENDING SECTION 62.188 OF THE SAN MARCOS CITY CODE TO REFLECT THE CHANGE; AND INCLUDING PROCEDURAL PROVISIONS RECITALS: 1. In February 2004, by Ordinance 2004-8, the San Marcos Fire Department was renamed San Marcos Fire and Rescue. In recognition of the Fire Department's upcoming 125th Anniversary, the Fire Department supports changing the name back to its historical name - San Marcos Fire Department. Additionally, the change would also assist in standardizing the department's name so that emblems, badges and document all carry the same designation (which is not currently the case). 2. An amendment to City Code is needed to implement this change. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS TEXAS: • SECTION 1. San Marcos Fire and Rescue is renamed San Marcos Fire Department. SECTION 2. Section 62.188 of the San Marcos City Code is amended as follows (strikethrough denotes deleted text, and underline denotes added text): Section 62.188 Name of department. The official name of the fire department is San Marcos Fire Department ^"'amxv Rescue. All references in the City Code to "fire department" or "San Marcos Fire and Rescue Dot" mean San Marcos Fire Department an . SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed SECTION 5. This Ordinance will take effect upon final passage.
