7. Section 7.3 of the Agreement is hereby amended to read as follows 7.3 County shall acquire, at its expense, all right of way necessary for construction of the FM 110 Segment except as provided in Section 5.3. 8. Section 8.1 of the Agreement is hereby amended to read as follows 8.1 City estimates that the cost of completing the City Segment will be approximately Twelve Million One Hundred Thousand Dollars ($12,100,000 USD). This sum would be paid from the following sources: Proceeds from the Sale of Certificate of Obligation in an amount not to exceed Nine Million Eight Hundred Thousand Dollars ($9,800,000 USD) and Two Million Three Hundred Thousand Dollars $2,300,000 USD) to be paid by County to City as provided in Section 6.2 of this Agreement. Payment for water and wastewater lines along the City Segment and along the County Segment shall be paid from City's capital improvement program. 9. Section 8.3 of the Agreement is hereby amended to read as follows 8.3 County estimates that the cost of completing FM 110 from McCarty Lane - City Segment to SH 123 will be approximately Nineteen Million Eight Hundred Thirty Four Thousand Three Hundred Ninety Six Dollars ($19,834,396 USD). This sum would be paid from the following sources: a) Funds arising from the issuance of road bonds that may be authorized by the vote of the citizens of Hays County on or about November 4, 2008. 10. The Parties hereby acknowledge that the Agreement, as amended by this First Amendment, is legally binding and remains in full force and effect.
