PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br />This Agreement is made this the 17th day of June, 2008, between the City of San Marcos, <br />Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Kellogg Brown & Root <br />Services, Inc., a Delaware Corporation ("Engineer"), 505 East Huntland Drive, Suite 100, <br />Austin, Texas 78752 for the provision of services in connection with the Comanche Water <br />Transmission Main (24") Project (the "Project"). <br />The City and the Engineer agree as follows: <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br />1.0 STANDARDS OF PERFORMANCE <br />1.0.1 Engineer will be responsible for the proper, accurate and adequate design and <br />preparation of plans and specifications and other construction contract documents and for <br />construction administration for the Project. The Project generally consists of the construction of <br />approximately 5,200 l.f. of the 24-inch Comanche Water Transmission Main extension between <br />the Spring Lake Pump Station and the Comanche Standpipe and includes: <br />a. An evaluation of the conceptual alignment between the Spring Lake Pump Station <br />and the Comanche Standpipe as depicted in the Water Distribution Master Plan to <br />determine potential constraints; <br />b. An evaluation of the existing and proposed pumping conditions; <br />c. An evaluation and determination of pumping improvements, if necessary <br />d. An evaluation and installation of a connection from the proposed 24-inch <br />Comanche Water Transmission Main to the Spring Lake ground storage tank; <br />e. The performance of a preliminary route survey and final survey during design phase <br />services; <br />f. The establishment of design criteria and project goals; <br />g. The preparation of a preliminary cost estimate; <br />h. The establishment ofright-of--way requirements; <br />i. The provision of preliminary construction sequencing goals to minimize conflict(s) <br />with the LBJ/Sessoms Drive Reconstruction project and other on-going projects; <br />j. The investigation of yard piping layout at the Spring Lake Pump Station site; <br />k. The development of a preliminary plan and profiles for the 24-inch water main; <br />1. The performance of a preliminary geotechnical investigation; <br />m. The performance of an environmental study related to threatened and endangered <br />species, waters of the U.S. and cultural resources; <br />n. The provision of the results of evaluation(s) and provision of recommendations. <br />1.0.2 The Engineer's Basic Services consist of the services described in Sections 1.0 through <br />1.6 and include normal civil engineering services for water transmission main engineering, <br />design and construction to be performed through the following consulting disciplines as <br />KBR-Comanche Water Transmission Main (24") Agreement <br />
