I anticipate using a similar arrangement for additional new representation of the City that we may be asked to do in the future. At some point, particularly as our rates are adjusted for the attorneys who are now or may be with the Firm, or the work differs from the general type of work that is described in this letter, we may seek to come to an agreement for those additional matters that deviates from the terms outlined in this letter. Based upon the proposal outlined above, I now want to respond to the request for a cost estimate in your September 30th e-mail, as modified by your subsequent e-mails. In light of the innovative fee proposal we are making. herein, which includes multiple cost savings and discounts to the City,. and the uncertainties associated with the intricacies of "water deals," complicated by our knowledge of prior dealings with GBRA, and the ability. to control the actions of GBRA in such contract negotiations, I normally would present my .estimate using a "high" and "low" range of costs. However, based upon the suggested modified project schedule, which contemplates concluding the deal by the end of October, I expect that our fees will not exceed $8,000.00. In the event that negotiations with GBRA break down and the work on the project becomes extended, or otherwise expands, I anticipate that our fees will exceed $8,000.00 and we will need to discuss a revised budget with the City. We will monitor our time in the project and advise you as early as possible in the event that we anticipate that the cost of the project will increase above the projected $8000.00 budget. I will be the principal attorney in our Firm working on this project. However, in an effort to provide the City with efficient and economical results, I will use associates, legal assistants or other qualified lower cost billing personnel as appropriate in connection with the matter. Billing rates charged for other finn personnel will be subject to the limits that are set out above, and will range from $45.00/hoUI for Case Clerks, $75.00/hour for Legal Assistants, and $145.00 to $225.00/hour for other attorneys. Our bills will be submitted monthly in a fonnat that follows our past practice to include a diary reflecting the services rendered and time spent by each billing member of the Finn on a daily basis. They will also include tabulation by category of expenses incurred. I will send these invoices directly to you for processing and payment. After you have an opportunity to consider the terms outlìned above, please call me if you have any questions. As you know, based upon the limited information available to me, the estimates related to the amount of time necessary to complete the project are my "best guess." If the. terms and conditions of our proposed engagement are satisfactory to the City, I would appreciate receiving an executed copy of this letter for our files.
