of each of the City Tract and the Owner Tracts is $10,000.00. 3.02. Site Work for Comanche Street Improvements. Owner agrees to ensure that site work to prepare the Owner tracts for the construction of the Comanche Street Improvements is performed in connection with the construction of the Residence Hall Facility, in accordance with plans and specifications submitted to and approved by the City. The City agrees to approve or disapprove the plans and specifications within thirty (30) days after they are submitted to the City, and in the event that the City has not specifically disapproved such plans and specifications within such thirty (30) day period, same will thereupon be deemed approved by the City. Upon substantial completion of this site work, Owner will notify the City, and the City will inspect the work and submit a punch list of correction items to Owner, which Owner will cause to be corrected. Owner agrees to ensure that this site work, including punch list items, is completed, and the Owner Tracts are available for construction work by the City, no later than 90 days prior to the scheduled date of completion of construction of the Residence Hall Facility, so that the Comanche Street Improvements can be completed at the same time as the Residence Hall Facility is completed. Owner will provide the City with written notice (the "Scheduled Completion Notice") of the scheduled coIl}pletion date for construction of the Residence Hall Facility at least 120 days prior to that date. . 3.03. Contribution towards Cost of Comanche Street Improvements/Construction of Comanche Street Improvements. Owner agrees to pay, or cause to be paid, to the City the sum of $15,000.00 to be applied by the City towards the cost of construction of the Comanche Street Improvements. This payment will be made within fifteen (15) days after the date of the Scheduled Completion Notice. Assuming that Owner timely makes such payment, the City will commence construction of the Comanche Street Improvements so that they can be completed at the same time as the Residence Hall Facility is completed. 3.04. Other Obligations of Owner. This agreement does not affect any other obligations Owner may have with respect to the construction of the Residence Hall Facility, including those related to the construction of on-site or off-site utility improvements related to the Residence Hall Facility, the payment of water and wastewater impact fees, or the relocation of electric utility poles, lines and related facilities, as applicable. 4. Title Report and Survey 4.01. City Tract Commitment. Within ten days ITom the effective date of this Agreement, the City will order from Hays County Abstract Company (the "Title Company") an owner's title policy commitment (the "City Tract Commitment") showing good and indefeasible title to the City Tract in the City and showing all encumbrances and other matters, if any, relating to the City Tract, together with a legible copy of each document referred to in the City Tract Commitment. 4.02.
