ORDINANCE NO. 2026-23 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS DESIGNATING FOUR PARKING SPACES FOR <br /> SAN MARCOS POLICE PARKING ONLY AND DESIGNATING <br /> SUCH SPACES AS NO PARKING TOW AWAY ZONES, AS <br /> AUTHORIZED IN SECTION 82.161 OF THE SAN MARCOS CITY <br /> CODE, TO IMPROVE POLICE ACCESSIBILITY AND RESPONSE <br /> TIMES, AND TO ENHANCE DOWNTOWN SECURITY <br /> OPERATIONS DURING PEAK ACTIVITY HOURS FROM 5:00 <br /> P.M. TO 3:00 A.M. DAILY; INCLUDING PROCEDURAL <br /> PROVISIONS; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. Section 82.161 of the San Marcos City Code authorizes any street, alley <br /> or city-owned property or part thereof to be designated as a no parking tow-away zone <br /> by ordinance. <br /> 2. The San Marcos Police Department requests to reserve four on-street <br /> parking spaces within the downtown area from 5:00 P.M. to 300 A.M. daily to support <br /> enhanced downtown security operations, as depicted in the map attached hereto and <br /> incorportaed herein for all purposes as Exhibit "A." <br /> 3. On February 23, 2026 the Parking Advisory Board adopted Resolution <br /> RR2026.O1RR-PAB recommending approval of such spaces for police parking as <br /> requested by the Police Department. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. The City Council hereby approves the designation of four parking <br /> spaces as San Marcos Police Parking Only during the peak hours of 5:00 P.M. and 3:00 <br /> A.M. daily as depicted in Exhibit"A." <br /> SECTION 2. During the hours listed in Section 1, the designated parking spaces <br /> shall be reserved exclusively for San Marcos Police Department officers and such spaces <br /> are also designated as no parking tow-away zones pursuant to Section 82.161. <br /> SECTION 3. If any word,phrase, clause, sentence, or paragraph of this ordinance <br /> is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br /> provisions of this ordinance will continue in force if they can be given effect without the <br /> invalid portion <br /> SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions <br /> in conflict with this ordinance are repealed. <br />
