• RESOLUTION NO. 2010-1 SR <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS CONSENTING TO THE INCLUSION <br />OF A PORTION OF THE CITY'S EXTRATERRITORIAL <br />JURISDICTION WITHIN THE PROPOSED CALDWELL <br />COUNTY EMERGENCY SERVICES DISTRICT NO. 2; AND <br />DECLARING AN EFFECTIVE DATE. <br />Recitals: <br />1. On or about November 16, 2009 the Caldwell County Judge received a petition <br />calling for an election on the creation of the proposed Caldwell County Emergency <br />Services District No. 2. (the "District"). <br />2. A portion of the proposed District lies within the extraterritorial jurisdiction of the <br />City of San Marcos, Texas. <br />3. Section 775.014 of the Texas Health and Safety Code requires a formal request to be <br />presented to the governing body of a municipality seeking consent to inclusion of its <br />extraterritorial jurisdiction within a proposed district. <br />4. The City of San Marcos received the consent request on or about December 22, 2009. <br />• 5. The San Marcos Fire Department and San Marcos Police Department reviewed the <br />proposed boundaries of the District and have recommended that the San Marcos City <br />Council express its consent by adoption of this resolution. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The San Marcos City Council hereby consents to the inclusion of a portion of the city's <br />extraterritorial jurisdiction within the proposed Caldwell County Emergency Services District <br />No. 2 in accordance with Section 775.014 of the Texas Health and Safety Code. <br />PART 2.
