RESOLUTION NO. 2026-95R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS GRANTING A REQUEST IN CASE NO. AC-25-09 FOR <br /> ALTERNATIVE COMPLIANCE TO THE MAXIMUM BUILDING <br /> HEIGHT REQUIREMENTS IN SECTION 4.4.3.7 OF THE <br /> DEVELOPMENT CODE TO INCREASE THE PERMITTED BUILDING <br /> HEIGHT FROM FIVE TO SEVEN STORIES, FOR A PROPOSED <br /> DEVELOPMENT LOCATED AT 325 NORTH COMANCHE STREET; <br /> AUTHORIZING CITY STAFF TO ISSUE PERMITS CONSISTENT WITH <br /> THIS RESOLUTION; AND DECLARING AN EFFECTIVE DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The request in Case No. AC-25-09 for Alternative Compliance to the <br /> maximum building height requirements in Section 4.4.3.7 of the Development Code to increase <br /> the permitted building height from five to seven stories for a proposed development at 325 North <br /> Comanche street is approved, subject to any conditions as are listed in Exhibit A. <br /> PART 2. City staff is hereby authorized to issue permits consistent with any <br /> Alternative Compliance approved by this resolution, subject to compliance with other applicable <br /> laws and ordinances. <br /> PART 3.
