<br />6. <br />Regular Meeting <br /> <br />October 27, 2003 <br /> <br />Page 6 <br /> <br />IMPROVMENTS PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THESE <br />DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither introduced for consideration Item 14, removed from the <br />consent agenda, adoption of the Ordinance on third and final reading, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO REVISE AND UPDATE <br />THE CITY ETHICS ORDINANCE; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />Ms. Narvaiz moved for adoption of the Ordinance on the third and final <br />reading and Mr. Mihalkanin seconded the motion. Mr. Mark Taylor stated <br />the revolving door restrictions were originally written to cover former <br />City employees and officials. He stated the wording Ubody of which the <br />employee was a member" needs clarity of application. He stated he has <br />provided three options. Mr. Mihalkanin inquired which option is the <br />closest to what the Council wants. Mr. Mark Taylor stated option 2. Mr. <br />Mihalkanin moved to amend Section 2.425 (a) (1) by striking Appear before <br />the body and inserting Appear at a meeting of a board or commission <br />staffed by members of the department, and Ms. Narvaiz seconded the motion, <br />which passed unanimously. The Council then voted for adoption of the <br />Ordinance on third and final reading. <br /> <br />Mayor Habingreither introduced for consideration Item 15, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE RESALE OF SEVERAL PARCELS OF REAL PROPERTY LOCATED IN <br />SAN MARCOS THAT HAVE BEEN FORECLOSED FOR UNPAID TAXES; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkaninmoved for adoption of the Resolution and 'Mr. Taylor <br />seconded the motion. Ms. Narvaiz stated she knows the importance of <br />getting properties back on the tax roll, but she feels this should be done <br />on a percentage of the property value. She feels some of these bids are <br />lower than the first bid. Mr. Thomaides inquired whether a percentage is <br />considered. Steve Byrd of Linebarger, Goggan, Blair & Sampson, LLP, <br />stated there is no minimum requirement. He stated no requirement has been <br />established, so they feel obligated to present all proposals. He stated <br />he has to provide the same proposal to Hays County and San Marcos <br />Independent School District for approval. He also stated the firm puts <br />signs up on most of these properties for advertisement. He stated all <br />fees are charged against the property, and these fees have to be paid <br />before the difference is divided among the other taxing entities. Mayor <br />Habingreither stated he feels these proposals should be accepted so they <br />can get back on the tax roll. Ms. Narvaiz inquired whether these <br />properties have been advertised. Mr. Byrd stated these properties have <br />been listed as public information. Ms. Narvaiz stated she feels these <br />
