<br />The stated limits of insurance required by this Paragraph are minimum onlv--they <br />do not limit the Subrecipient's indemnity obligation, and it will be the Subrecipient's <br />responsibility to determine what limits are adequate. These limits may be basic policy <br />limits or any combination of basic limits and umbrella limits. The City's acceptance of <br />Certificates of Insurance that do not comply with these requirements in any respect does <br />not release the Subrecipient from compliance with these requirements. <br /> <br />-Or- <br /> <br />Subrecipients funded for programs that will involve the transportation of beneficiaries in <br />motor vehicles will procure and maintain at Subrecipient's expense insurance with <br />insurance companies authorized to do business in the State of Texas, covering all <br />operations under this Agreement, whether performed by Subrecipient or Subrecipient's <br />agents, subcontractor or employees. Before commencing any services under this <br />Agreement, Subrecipient will furnish to the City a certificate or certificates in form <br />satisfactory to the City, showing that Subrecipient has complied with the insurance <br />requirements outlined below. All certificates will provide that the policy will not be changed <br />or canceled until at least 30 days written notice will have been given to the City. <br /> <br />Motor Vehicle liability insurance in amounts not less than $100,000 for injuries to anyone <br />person, $300,000 on account of anyone accident and in an amount of not less than <br />$100,000 for property damage. <br /> <br />The stated limits of insurance required by this Paragraph are minimum onlv--they do not <br />limit the Subrecipient's indemnity obligation, and it will be the Subrecipient's responsibility <br />to determine what limits are adequate. The City's acceptance of Certificates of <br />Insurance that do not comply with these requirements in any respect does not release the <br />Subrecipient from compliance with these requirements. <br /> <br />-Or- <br /> <br />Subrecipients whose funded program/project does not include construçtion activities or the <br />transportation of beneficiaries in motor vehicles are exempted from insurance <br />requirements. <br /> <br />5.6 <br /> <br />Conflict of Interest. <br /> <br />(a) The conflict of interest provisions of this section apply to any person who is an <br />employee, agent, consultant, officer, or elected or appointed official of the City of San <br />Marcos, or of subrecipients receiving CDBG funds from the City of San Marcos. <br /> <br />(b) No persons described in subsection (a) of this section who exercise or have exercised <br />any functions or responsibilities with respect to CDBG activities, or who are in a position <br /> <br />5 <br />
