<br />8.2 The disposition of any asset improved or acquired in part or in whole with CDBG <br />funds by the Subrecipient must be done with prior approval of the City and City will be <br />reimbursed for the asset if sold, in the full amount of the disposed value of the asset. The <br />City may, at its option, request that such asset be transferred to the City if the asset is no <br />longer being used to meet one of the three national objectives or in any case where <br />Subrecipient no longer provides services shown on Exhibit A. The Subrecipient will <br />transfer the asset to the City if the City makes such a request. <br /> <br />8.3 Upon expiration of this Agreement or if Subrecipient discontinues its services under <br />this Agreement, it will immediately remit to the City all unexpended CDBG grant funds <br />received from the City. The City has authorization from HUD to collect these CDBG funds. <br />Any unexpended funds still remaining will be appropriated to eligible CDBG activities in <br />compliance with the City's budgetary process. <br /> <br />8.4 If Subrecipient uses CBDG funds provided under this Agreement to acquire real <br />property, Subrecipient acknowledges and agrees that Subrecipient will execute documents <br />to create a lien in favor of the City to secure the performance of this Agreement by <br />Subrecipient. The City agrees to release this lien upon satisfactory performance of this <br />Agreement by Subrecipient. <br /> <br />ARTICLE 9 <br />TIME OF PERFORMANCE <br /> <br />9.1 The effective date of this Agreement is the 1 st day of October - and the <br />termination date will be the <br /> <br />ARTICLE 10 <br />PAYMENTS AND PROGRAM INCOME <br /> <br />10.1 The City agrees to grant to Subrecipient an amount not to exceed $ for <br />Subrecipient's performance in accordance with the Statement of Work, as delineated in <br />Exhibit B, Project Budget of this Agreement and in keeping with the reçord of expenditures. <br /> <br />10.2 The City will make payments to the Subrecipient following the submission of <br />completed pay requests with required documentation in conformance with Article 3 of this <br />Agreement. <br /> <br />10.3 The receipt of program income under this Agreement is not anticipated. However, <br />if the Subrecipient receives program income for any activity it performs under this <br />Agreement it will comply with all applicable regulations specified in 24 C.F.R. Section <br />570.500. Subrecipient agrees to return eligible program income, if any, to the City. <br /> <br />ARTICLE 11 <br />AUDIT <br /> <br />8 <br />
