(e) Any terms defined elsewhere in this First Supplement have the meanings attributed to <br />them where defined. <br />(f) The captions or headings are for convenience only and in no way define, limit or describe <br />the scope or intent, or control or affect the meaning or construction, of any provisions or sections <br />hereof. <br />(g) Any references to Section numbers are to Sections of this First Supplement unless stated <br />otherwise. <br />Section 7.14. NO PERSONAL LIABILITY. No covenant or agreement contained in the <br />Bonds, this First Supplement or any corollary instrument shall be deemed to be the covenant or <br />agreement of any member of the City Council or any officer, agent, employee or representative of <br />the City in his individual capacity, and neither the City Council, directors, members, officers, agents, <br />employees or representatives of the City nor any person executing the Bonds shall be personally <br />liable thereon or be subject to any personal liability for damages or otherwise or accountability by <br />reason of the issuance thereof, or any actions taken or duties performed in relation to the issuance <br />of the Bonds, whether by virtue of any constitution, statute or rule of law, or by the enforcement of <br />any assessment or penalty, or otherwise, all such liability being expressly released and waived as <br />a condition of and in consideration for the issuance of the Bonds. <br />Section 7.15. PAYMENT OF ATTORNEY GENERAL FEE. The City hereby authorizes <br />the disbursement of a fee equal to the lesser of (i) one-tenth of one percent of the principal amount <br />of the Bonds of each Series or (ii) $9,500 per Series, provided that such fee shall not be less than <br />$750, to the Attorney General of Texas Public Finance Division for payment of the examination fee <br />charged by the State of Texas for the Attorney General's review and approval of public securities <br />and credit agreements, as required by Section 1202.004 of the Texas Government Code. The <br />Authorized Representative is hereby instructed to take the necessary measures to make this payment. <br />The City is also authorized to reimburse the appropriate City funds for such payment from proceeds <br />of the Bonds of each Series. <br />SAN MARCOS 2008: FirstSupplementalOrdinance 2,6 <br />
