RESOLUTION 2008-95R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE DEPOSIT TO THE COUNTY <br />COURT REGISTRY OF THE SPECIAL COMMISSIONER'S AWARD <br />IN THE AMOUNT OF $562,777.00 FOR THE RIGHT OF <br />POSSESSION AND EVENTUAL PURCHASE OF 9.5801 ACRES, <br />MORE OR LESS, AND 0.1772 ACRES, MORE OR LESS, FOR USE <br />AS RIGHT-OF-WAY IN CONNECTION WITH THE WONDER <br />WORLD DRIVE EXTENSION PROJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. Pursuant to the Wonder World Drive Extension Pass-Through Toll Agreement <br />between the City of San Marcos, Texas and the Texas Department of Transportation, <br />the City is responsible for acquiring the right of way for the project. <br />2. The City initiated condemnation proceedings in order to acquire 9.5801 acres and <br />0.1772 acres of land, more or less, for part of the Wonder World Drive Extension right- <br />of-way from Charles C. Laidley and Dorothy Laidley. The right-of-way being purchased <br />passes through Mr. Laidley's house; therefore the value of his house is part of the <br />damages that will be paid. <br />3. On April 3, 2008, a hearing was held before Special Commissioners who were <br />appointed by the Court to determine the value of the land, and any resulting damages, <br />taken by the City. At the conclusion of the hearing the Commissioners found that the <br />value of the land, including damages, is $562,777.00. <br />4. In order to take full possession of the land and to proceed in obtaining title thereto, <br />the City must deposit the funds into the Court's registry. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The deposit to the registry of the County Court for the purchase of <br />right-of-way in connection with the Wonder World Drive Extension Project is hereby <br />approved: <br />A. Parcel Numbers 8 and 8E respectively consisting of 9.5801 acres and <br />0.1722 acres, more or less, as depicted on the attached Award of Commissioners, <br />owned by Charles and Dorothy. Laidley., for the amount of $562,777.00. <br />Part 2. This Resolution is in full force and effect from and after its passage. <br />
