The Texas Legislature has revised the State vital statistics statute to authorize local <br />registrars of vital statistics to charge an additional $1.00 fee for birth and death certificates to provide <br />funding for the preservation of vital statistics records. <br /> <br />2. The City Clerk, who serVes as the City's local registrar, has recommended that the City <br />Council consider approval of this fee increase to provide funding for the preservation of City vital <br />statistics records. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 2.4810fthe City Code is amended as follows (underlining indicates <br />added text): <br /> <br />Sec. 2.481. Vital statistics records; fees. <br /> <br />(a) The local registrar of the city shall, upon request, supply to any properly qualified <br />applicant a certified copy of any birth, death or fetal death record. The local registrar shall <br />charge the same fee for these copies as is charged by the state agency that maintains vital <br />statistics records, and an additional fee of $1.00 for the preservation of vital statistics records <br />maintained by the registrar. <br /> <br />(b) The local registrar shall charge the same fee for performing searches of birth, death and <br />fetal death records as is charged by the state agency that maintains vital statistics records. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 4.
