(d) The Police Chief or designee shall not issue an organization a permit for a given <br />date(s) or location(s) if a permit has already been issued to another organization for such <br />date(s) and location(s). <br /> <br />(e) The Police Chief or designee shall grant or deny a permit solely on the basis of the <br />requirements stated in subsections (c) and (d) above. The Police Chief or designee shall <br />advise the organizatioffs point of contact of the decision to grant or deny the permit, not <br />later than the tenth day after date of receiving the completed application and all required <br />attachments. <br /> <br />(f) If a pemfit is granted, it shall state the name of the organization, the names of persons <br />who will be soliciting contributions for the organization, and the approved date(s) and <br />location(s). The organization shall at its expense make sufficient copies of the permit so <br />that each person engaged in soliciting has a copyat each approved location and shall <br />readily present such copy for inspection upon demand by any person. <br /> <br />(g) If a pemfit is denied, the applicant may appeal to the City Council by filing a letter <br />with the City Clerk indicating why the decision to deny the permit was incorrect, and why <br />the permit should be granted. This letter must be filed no later thm~ three business days <br />after the notice of denial. The City Council shall decide the matter and advise the <br />organization's point of contact of the decision no later than the fifteenth day after <br />receiving the appeal letter. The City Council's decision is final. <br /> <br />(h) A person soliciting or attempting to solicit a charitable contribution commits an <br />offense if the person violates any of the following requirements: <br /> <br />(1) The person must be at least 18 years of age. <br /> <br />(2) The person must be named on the organization's permit. <br /> <br /> (3) The person must wear a reflective orange or yellow visibility vest as an outer <br />most garment. <br /> <br /> (4) The person must be in the street or highway only when the controlling traffic <br />signal light prohibits vehicle movement in that lane. <br /> <br /> (5) The person must remain within one 100 feet of or from an intersection <br />approved in the permit. <br /> <br /> (6) The person must place an orange traffic control cone, not less than 24 inches <br />in height, on the center stripe of each street and highway approaching the intersection, <br />between 100 and 150 feet from the intersection, to warn drivers ora hazard ahead. <br /> <br /> (7) The person must present for inspection a copy of the permit issued to the <br />person's organization upon demand by any person. <br /> <br /> <br />
