<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOTS 18 AND 19 OF WILLIAM GOFORTH'S FIRST SUBURBAN
<br />ADDITION TO THE CITY OF SAN MARCOS, HAYS COUNTY, AS
<br />RECORDED IN VOLUME 88, PAGE 80 OF THE HAYS COUNTY DEED
<br />RECORDS; A/K/A 1903 POST ROAD FROM "M" (SINGLE, FAMILY,
<br />DUPLEX NEIGHBORHOOD BUSINESS DISTRICT) TO "c" (COMMERCIAL)¡
<br />AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on February 3, 1987, the Zoning Cnmmission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "M" (Single Family, Duplex, Neighborhood Business
<br />District to "c" (Commercial District) of Lots 18 and 19 of William
<br />Goforth's First Suburban Addition to the City of San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on February 3, 1987, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City¡ and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />March, 1987, regarding such request¡ and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "M" (Single Family, Duplex, Neighborhood Business District) be
<br />rezoned "c" (Commercial District):
<br />
<br />LOTS 18 AND 19 OF WILLIAM GOFORTH'S FIRST SUBURBAN ADDITION TO
<br />THE CITY OF SAN MARCOS, HAYS COUNTY, AS RECORDED IN VOLUME
<br />88, PAGE 80 OF THE HAYS COUNTY DEED RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on April 13, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 23 day of March , 1987,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for April 13, 1987.
