<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />HARCOS, TEXAS, AHENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING BLOCK 10, LOT D OF SCHNEIDERS REARRANGEMENT
<br />OF LOTS 51 AND 52, BLOCK 10 OF THE WESTOVER ADDITION TO
<br />THE CITY OF SAN MARCOS AS RECORDED IN VOLUME 4, PAGE 275
<br />OF THE HAYS COUNTY PLAT RECORDS, LOCATED AT THE SOUTH
<br />CORNER OF THE INTERSECTION OF CLYDE STREET AND BAYLOR
<br />STREET FRQr.1 "R-l" (SINGLE FAMI LY D\¡\]ELLING DISTRICT- LOW
<br />DENSITY) TO "DP-2" (DUPLEX DISTRICT-MEDIUM DENSITY);
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on November 4, 1986, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "R-l" (Single Family Dwelling District-Low Density)
<br />to "DP-2" (Duplex District-Medium Density) of Block 10, Lot D
<br />of Schneiders Rearrangement of Lots 51 and 52, Block 10 of the
<br />Westover Addition to the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on November 4, 1986, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />April, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"R-l" (Single Family Dwelling District-Low Density) be rezoned "DP-2"
<br />(Duplex District-Medium Density):
<br />
<br />BLOCK 10, LOT D OF SCHNEIDERS REARRANGEMENT OF LOTS 51
<br />AND 52, BLOCK 10 OF THE WESTOVER ADDITION TO THE CITY OF SAN
<br />MARCOS AS RECORDED IN VOLUME 4, PAGE 275 OF THE HAYS COUNTY PLAT
<br />RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on April 27, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 13 day of April
<br />subject to reconsideration at the next regular City Council
<br />scheduled for April 27, 1987
