MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Jones, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2010-5, • <br />as previously captioned. The motion carried unanimously. <br />23. Public Hearing to consider comments for and against an amendment to the future land <br />use map from "LDR" Low Density Residential to "MDR" Medium Density Residential for <br />a tract of land located at 1105 Hillver Street; amending the official zoning may of the City <br />by rezoning this tract from "SF-6" Single Family Residential District to "DR" Duplex <br />Restricted Residential District (Medium Density); and including procedural provisions; <br />and consider adoption of Zoning Ordinance 2010-6. <br />Mayor Narvaiz opened the Public Hearing at 8:10 p.m. <br />There being no further comments, the Public Hearing was closed at 8:11 p.m. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Thomason, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance <br />2010-6, as previously captioned. Main Street Advisory Commission <br />• <br />Bob Sappington was appointed to the Main Street Advisory Commission. <br />25. Consider adoption of Ordinance 2010-7, on emergencv, amending the Citv's 2009-2010 <br />budget to authorize the transfer of $545,717.38 from the Water and Wastewater Fund <br />balance to the Water and Wastewater Improvements Fund to cover additional expenses <br />related to the Citv's Smart Metering Proiect; declaring an emergencv and providing an <br />effective date. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Terry, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2010-7, <br />on emergency, as previously captioned. The motion carried unanimously. <br />26. Update and discussion on a proposed graffiti ordinance, and provide direction to staff. <br />Police Chief Howard Williams provided an update and chronology on the proposed graffiti <br />ordinance. State law has changed requiring an adult defendant to pay $50 to help defray the <br />expense of removing the graffiti, along with some changes regarding juveniles. Also, the Local <br />Government Code now prohibits the City from compelling a private property owner to remove <br />graffiti. He also reported on graffiti management efforts enforcement and removal efforts (155 <br />hours of labor). Staff recommends developing a public service education program on the <br />harmful effects of graffiti and to keep the ordinance on the table for one year to see the effects of <br />the new laws and education program. <br />RM020210 Minutes Page 6
